Letters of Engagement - Why you, the client, should ask for one

As the client (whether of a law firm, accountants, or other services professional), it is usually a good idea to ask for a Letter of Engagement.  This is basically a letter from the professional which outlines to you, the client the following:

  1. Who the firm is acting for (i.e. you, the client)
  2. What services will be provided, and the scope or limitations of these services
  3. What documents or information the professional requires or is relying on in order to provide these services
  4. What possible obstacles there are, and reasons for possible delays
  5. What these services will cost - in time, in fees, and in out of pocket expenses
  6. When does the professional expect to finish providing the services - are these on-going, one-off, or staged?
  7. When are you expected to pay for these services?  Are you expected to put up a retainer in order to cover the out of pocket expenses?  Will you be presented with a monthly invoice?  How soon after the invoice is presented are you expected to pay?  Is there interest due on unpaid balances?

We recommend to prospective and existing clients that they request the letter of engagement after any meeting which is held to discuss possible representation by our firm.  Of course, the client is also expected to return a signed copy of the letter to us, which lets us know that you have read and understood the letter and the scope and extent of the services which will be provided.
