Trademark Registration

If you intend on registering a Trademark in Panama, then you will need to provide the following documents and/or information: 

  1. Power of Attorney (duly authenticated by Apostille or the Panamanian Consulate) - to request a power of attorney model, please send an email

  2. If the applicant is a legal person (i.e. corporation, partnership, etc.), then a Certificate of Good Standing issued by the relevant authority, which must also be duly Apostilled or authenticated by the Panamanian Consulate.  If the owner of the trademark is a Panamanian Corporation, then the Certificate of Good Standing should be requested in Panama at the Public Registry.   

  3. An Affidavit by the Applicant stating that the trademark is theirs, the length of time for which they have been using the trademark, duly Apostilled or authenticated by the Panamanian Consulate - to request a sample Affidavit, please send an email.

  4. Six (6) labels (samples) - approximate size= 2x3 inches [of the trademark]

  5. Name and/or design of the trademark

  6. Specification of the products or services on which the trademark is to be used - only one class of product or service per application.  [see: Classes of Goods & Services]

  7. In the event that the trademark has already been registered in the domicile of the applicant or elsewhere, and the applicant wishes to claim priority to the exclusive right of use, then you should forward to us authenticated (Apostille or Panamanian Consulate) documents which may be used as evidence of these rights

The Registration Process:

Once the paperwork for the trademark application has been received, this will be presented to the Ministry of Commerce & Industry (MICI) together with the application form. We do request that at the time of requesting the registration that a down payment be made which covers all out-of-pocket expenses.  Legal fees will be charged once the trademark has been published in the Bulletin. 

After the trademark application has been made, the MICI will review the application (please note that currently MICI is about 3 months behind in the review of applications, and so it will take a while before they have reviewed it and prepared it for publication).  After the review has been done, and the application has been found to be in order, the trade mark will be allocated to a bulletin for publication (usually about 3-4 weeks later).  Once published, we will scan and email to you a copy of the publication. 

After publication, it is necessary to wait 3 months to allow for oppositions to be filed against the application.  These oppositions are usually filed by other trademark holders who consider that the applicant's product or service mark is too closely related to their mark so as to cause confusion between them.  If there are no oppositions presented, then the trademark will be registered and the MICI will issue a certificate of registration.  Please note, however, that the issuance of this certificate of registration is not instantaneous, and may take up to two months after the deadline for oppositions have been filed. 

Overall, you can expect that the registration process will take 6-9 months.
