The Repatriation Deposit paid to the Immigration Department (Ministerio de Gobierno y Justicia) for Immigrant Investors

The Repatriation Deposit is governed by Articles 45 and 46 of the Immigration Law (Decreto Ley 16 of 1960).  These two articles provide:

Artículo 45. El depósito de repatriación de que trata el parte i) del artículo 26 de este Decreto Ley ingresará al Fondo Especial de la Dirección Nacional de Migración y Naturalización del Ministerio de Gobierno y Justicia, un (1) año después de la fecha en que el inmigrante haya ingresado al país. 

El Ministerio de Gobierno y Justicia deberá mantener icho Fondo Especial depositado en el Banco Nacional y rendirá cuenta comprobada del mismo, al Contralor General de la República trimestralmente. 

  Artículo 46. Mientras transcurre el año a que se refiere el Artículo 45, los depósitos de los inmigrntes serán mantenidos en una cuenta especial del Banco Nacional y sólo serán utilizados para los efectos siguientes:
    a). Para devolver el depósito al interesado, cuando salga del país antes de haber transcurrido un (1) año desde la fecha en que ingresó al territorio de la República, siempre que éste haya hecho saber por escrito a la Dirección Nacional de Migración y Naturalización, antes de su salida, que abandona el país definitivamente;
    b). Para cubrir los gastos de deporatción que ocasionen los extranjeros.  Tales gastos comprenden los referentes a alimentación, hospedaje, atención médica, medicina, hospitalización, transporte y cualquier otro que se requira;
    c). Para cubrir los gastos de repatriación de los panameños que se encuentren en estado de indigencia en el exterior.

English:

Article 45. The Repatriation Deposit dealt with in part i) of Article 26 of this Decreto Ley shall be deposited into the Special Fund of the Immigration and Naturalisation Department of the Ministry of Government & Justice, one (1) year after the date on which the immigrant landed in the country.

The Ministry of Government and Justice shall maintain said Special Fund in the Banco Nacional and shall render accounts of the same to the Contralor General de la República quarterly.

  Article 46. While the year referred to in Article 45 has not passed, the immigrants deposits shall be maintained in a special account in Banco Nacional and shall only be used for the following:
    a). To return to the party in question, when they leave the country before the year (1) is up from the date on which they landed on Panamanian soil, insofar as they have notified the Immigration and Naturalisation Department in writing, before leaving the country, that they are leaving permanently;
    b). To cover the deportation costs incurred by foreigners.  Such costs include those of food, lodging, medical attention, medication, hospitalisation, transport and any other required;
    c). To cover those repatriation costs of Panamanians overseas who are in economic squalor. 

Therefore, immigrants are advised that they will not receive the repatriation deposit back from the Ministry of Government & Justice upon completion of their immigration process and obtaining permanent residency status in Panama.  This repatriation deposit will become part of the Immigration & Naturalisation Department's funds. 

Nor will a person receive the repatriation deposit back should they decide, during the immigration process, to change from one type of immigrant visa to another.  The requirement above for return of the funds during the first year (after arrival in Panama, not after submission of the repatriation deposit) is that the person leave Panama permanently and notify the Immigration Department in writing of their intent to do so.
