TRANSLATION:  Rate of Minimum Professional Fees for Lawyers in the Republic of Panama

Part V: Procedural Law (Civil and Commercial)

Matters of Procedural Law (Civil and Commercial):

1. Summary Proceedings:   

a) Small claims

25% of the amount in dispute
b) Regular claims up to $2,000.00

20% of the amount
  Between $2,000 to $10,000.00 15% of the amount
  Between $10,000 to $100,000.00 10%
  Above $100,000.00 15%
The same fees will apply to third party claims (inclusion or exclusions).  If assets are frozen or judicial inspections are practised, out of the lawyer's domicile, the rates can be increased by up to 15%.

2. Ordinary Proceedings:

  a) Small claims   25% of the amount
  b) Regular claims    
  up to $20,000.00   25%
  from $20,000 to $100,000.00   20%
  from $100,000 to $500,000.00   15%
  from $500,000 to $1,000,000.00   10%
  above $1,000,000.00   7.5%
2.1 Representing a third party   50% of the rate established for a party
2.2 Representation of third party called into the proceedings   full fees
Note: the minimum fees established above shall be applied in a progressive manner.

3. Ex-Parte Proceedings & Un-contested Hearings

Declarative, assertive, informative for perpetuity and suchlike minimum $2,000.00
If it becomes contentious, the general rules should be followed.

4. Probate Proceedings Testamentary or Intestate:

Up to $50,000 15% of the estate
above $50,00 10% of the estate
NOTE:
a)   the previous fees refer only the process to obtain the transfer of rights and obligations of the deceased to his/her heirs, assuming that it is unrelated to any supplementary proceedings to that of probate.  But the ordinary proceedings regarding annulment of the last will and testament, child support for minors, reivindicación of estate assets, contested statements about heirs, etc., shall be established according to the professional fees stated in Section 2. above.
b)   When joint assets are liquidated and adjudicated to the surviving spouse, the rates established in Family & Children's Court shall apply.
c)   When in a probate process there are various heirs represented by separate lawyers, the professional fees shall be calculated according to the inheritance received by each heir that the lawyer represents.
d)   In the event that the debts reach or exceed half of the assets, the above professional fees shall increase proportionally from 25 to 50%. 

NOTE:
a) The above fees refer only to the process to get the rights and obligations of the deceased to the heir, without including any ancillary matters which may be dealt with. But the ordinary proceedings which may exist to nullify a Testament, request a pension for minors, replevin of inherited property, declarations regarding conflicting heirs, etc. shall be governed by the fees set forth in Section 2 above.  

Proceedings before the Commercial Courts

In order to establish the Professional Fees for representation before the Commercial Courts, the rates established for the Ordinary Proceedings, according to the amount and nature of the process, shall apply. 

Maritime Courts

In maritime proceedings, where possible, the rates approved for Ordinary Proceedings shall apply.  In those judicial or out-of-court tasks in which professional services are required from the lawyer, a rate of $200.00 per hour shall apply.

Special Proceedings

PROCESOS ESPECIALES
1. Deslinde y Amojonamiento o División o Venta de Bien Común:
Hasta B/. 20,000.00 25%
De 20,001.00 en adelante 10%
La cuantía se determina por el valor de los derechos que corresponden al interesado.
2. Procesos Posesorios.
Se pactará en forma convencional, con base a un mínimo de B/. 1,000.00 teniendo en cuenta la complejidad del negocio, la cuantía de los bienes, la labor requerida, las condiciones especiales de la práctica, especialidad profesional y la capacidad económica del interesado.
3. Rendición de cuentas. Se aplica la tarifa de los procesos ejecutivos
4. Pago por consignación: 20% de la cuantía, con un mínimo de B/.300.00
5. Desahucio y Lanzamiento ante Tribunales Ordinarios B/.5,000.00
6. Restitución de bienes con reserva de dominio B/.1,000.00
7. Inspecciones sobre medidas y linderos
Predios urbanos B/.500.00 a 2,000.00
Predios rurales B/.500.00 a 3,000.00

Nota: En caso de no existir controversia podrá el abogado reducir la tarifa hasta un 25%.
