Consultations and Opinions requested to Lawyers or Law Firms

1. Verbal Consultation minimum hourly rate $50.00
2. Verbal Consultation with review of documents hourly $150.00
3. Opinion Letter hourly $150.00
4. Requests for advice electronically   as agreed

Preparation of Resolutions without Title Searches and Preparation of Documents

1. An agreed upon rate taking into account the complexity of the work, time required and value of the work done hourly $200.00
2. Drafting of documents which have sale & purchase agreements, exchanges, leasing, assignment of debts or rights of action, option agreements, settlement agreements, guaranteed or non-guaranteed loans, liens, trusts, limited rights in rem, prenuptial agreements, non-judicial settlement agreements, contracts for projects and similar nature matters, supplementary agreements, and in general, all documents, contracts, transactions and acts related to the delivery, promise, receipt, payment or declaration of a sum of money, cash, or equivalent assets, shall result in professional fees due according to the value of the respective operation, in accordance with the following rates, in a progressive fashion:     
  a)  from $0.01 to $3,000.00   $200.00
  b) from $3,000.01 to $5,000.00   $250.00
  c) from $5,000.01 to $10,000.00   $275.00
  d) from $10,000.01 to $30,000.00   $400.00
  e) from $30,000.01 to $50,000.00   $500.00
  f) from $50,000.01 to $100,000.00   $800.00
  g) from $100,000.01 to $150,000.00   $1,500.00
  h) from $150,000.01 to $200,000.00   $1,550.00
  i) from $200,000.01 to $250,000.00   $1,575.00
  j) from $250,000.01 to $2,000,000.00   3.5%

[Example: For a transaction for $300,000.00 the fees charged would be:  $200.00 + $250.00 + $275.00 + $400.00 + $500.00 + $800.00 + $1,500.00 + $1,550.00 + $1,575.00 + 3.5% of $50,000.00 ($1,750.00) = $8,800.00.  If calculated at a straight 3.5% of the $300,000.00, the fees would be $10,500.00].

FIRST PARAGRAPH: The fees for transactions above Two Million Dollars ($2,000,000.00) shall be calculated as agreed.

SECOND PARAGRAPH:   If the complexity, novelty or difficulty of the matter submitted to the lawyer will require more time to be spent than normal, the lawyer may establish their fees on the basis of an hourly rate, with a minimum of $150.00/hour. 

THIRD PARAGRAPH:  Where documents cover various transactions, the fees shall be charged according to the value of each transaction, except as provided in the heading of this article, where there are loan documents and it is the same creditor. 

FOURTH PARAGRAPH: In rental agreements and the like, the amount of fees shall be calculated according to the amount to be paid during the term of the contract (i.e. for a monthly rental of $1,000.00, for a one year period, the basis would be $12,000.00).  In the case of a lease for an indefinite time period, the calculation should be based on the rent due during a two year period.

FIFTH PARAGRAPH:  In the drafting of documents for incorporation into the Horizontal Property Regime (Condominiums), a rate of one/1,000 of the value attributed to the property, with a minimum charge of $3,000.00 per document. 

SIXTH PARAGRAPH:  The cancellation of a mortgage and any other guarantee will result in a minimum fee of Three Hundred Dollars ($300.00), except where otherwise agreed.

SEVENTH PARAGRAPH:  The supplementary titles shall result in a minimum fee according to the value of the asset, in accordance with the rate established in the first part of this article, and with the limitations established in the FIRST paragraph.

Preparation of Legal Documents

1. Preparation of Minutes for the Declaration of Improvements, according to the value minimum $250.00
2. Drafting of powers shall result in minimum fees according to the following rates:    
  a) Power of Attorney from a natural person   $100.00
  b) Power of Attorney from a legal person for legal representation, without actually exercising the power of attorney   $200.00

Title Searches (does not include preparation of the Minute)

1. For transactions for a value of no more than $10,000.00 as agreed with minimum of $150.00
2. For transactions between $10,000.00 and $25,000.00 as agreed: less than 2% of the value of the transaction, with minimum of $350.00
3. For transactions between $25,000.00 and $50,000.00 as agreed: less than 1.5% of the value of the transaction, with minimum of $450.00
4. For transactions between $50,000.00 and $100,000.00 as agreed: less than 1% of the value of the transaction, with minimum of $750.00
5. For transactions between $100,000.00 and $250,000.00 as agreed: less than 0.0085% of the value of the transaction, with minimum of $1,000.00
6. For transactions between $250,000.00 and $1,000,000.00 as agreed: less than 0.0075% of the value of the transaction, with a minimum of $1,000.00
7. For transactions over $1,000,000.00 as agreed: at least 0.0065% of the value of the transaction, with a minimum of $1,875.00

FIRST PARAGRAPH: When the work includes the preparation of the sale Minute, the percentage may be doubled, but the professional fees should never exceed $50,000.00 unless the service has been calculated based on $150.00 per hour of work, in which case the professional fees are unlimited.  

Matters of Sanitary Law

1. Sanitary registration of Medications, cosmetics, food and liquor each $350.00
2. Renewal   $350.00
3. Suppression or change or modification of side-effects or effects or warnings or excipients or about doses or colours   $300.00
4. Transfer   $300.00
5. Modification of the name of the product   $300.00
6. Modification of the formula of the product or reformulation   $300.00
7. Suppression of the requirement for sale with prescription   $300.00
8. Change of the name of the owner   $300.00
9. Sanitary license for operation and registration of Laboratories (Types A, B, C & E)   $400.00
10. Request for speedy revision   $200.00
11. Request for approval of labels or modification of advertising   $300.00
12. Change of fabricant   $300.00
13. Identification or determination of the generic name of the product   $300.00
14. Modification or amendment of resolutions   $300.00
15. Abandonment of the application   $300.00
16 In all other matters, where possible, the rates for industrial property should be followed.
